Medplum GitHub Star T-Shirt Giveaway: Terms and Conditions

1. Nature of the Promotion and Eligibility

Nature of Offer: This T-Shirt Giveaway (“Giveaway”) is a promotional offer by Medplum, Inc. (“Medplum”) and is not a contest, lottery, or sweepstakes. Participation constitutes the participant’s full and unconditional agreement to these Terms and Conditions.
Eligibility: This offer is open only to individuals who visit and optionally give a star to the Medplum GitHub repository at https://github.com/medplum/medplum.
No Purchase or Payment Required: No purchase, payment, or other consideration is required to receive a t-shirt. Giving a GitHub star is voluntary and has no effect on eligibility. Participants who prefer not to star the repository may alternatively request a t-shirt by emailing tshirt@medplum.com with the subject line “Alternate Request.” Requests received by email will be honored on the same “while supplies last” basis and subject to these Terms.
Age Restriction: Participants must be 18 years of age or older (or the age of majority in their jurisdiction of residence, whichever is higher) to be eligible.
Limit: Limit one (1) t-shirt per person and per mailing address. Duplicate requests will be voided.
Geographic Limitation: Valid only for shipping addresses in the United States and Canada. Medplum is unable to fulfill requests to any other location.

2. Fulfillment, Availability, and Disclaimers

Availability (“While Supplies Last”): T-shirts are available strictly on a “while supplies last” basis. Fulfillment is not guaranteed. Once the current inventory is exhausted, the Giveaway will end immediately without further notice.
Fulfillment Partner: T-shirt fulfillment and shipping are handled by Medplum’s third-party supplier, Printfection. By participating, you acknowledge that Printfection may process your shipping information solely for fulfillment in accordance with its privacy policy.
Shipping Disclaimer: Medplum is not responsible for shipping delays, lost packages, errors, or issues once the t-shirt has been handed over to the shipping carrier or fulfillment partner. Participants agree to look solely to the carrier for any shipping claims.
Taxes and Value: The t-shirt has no cash value. Participants are responsible for any applicable taxes, if any, related to receipt of the t-shirt.

3. Right to Refuse, Modify, and Terminate

Right to Refuse or Disqualify: Medplum reserves the right, in its sole discretion, to refuse fulfillment, service, or participation to any individual for any reason, including but not limited to suspected fraud, abuse of the offer, or misrepresentation.
Modification and Termination: Medplum reserves the right to modify, suspend, or terminate the Giveaway, including these Terms and Conditions, at any time and for any reason without prior notice. Modifications will not affect t-shirts already fulfilled or in process.

4. Limitation of Liability and Privacy

Limitation of Liability: By participating, participants agree to release and hold harmless Medplum and its affiliates, officers, employees, and agents from any and all liability, including without limitation any claims, injury, death, loss, or damage arising from or in connection with the acceptance, possession, or use/misuse of the t-shirt or participation in the Giveaway.
Privacy and Data Use: Personal data (such as name, email, and shipping address) collected during fulfillment will be used solely for shipping the t-shirt and for no other marketing purposes without the participant’s explicit consent. Data may be processed and stored in the United States. Medplum will handle all data in accordance with its Privacy Policy, available at https://www.medplum.com/privacy.
Data Retention: Personal data collected for fulfillment will be securely deleted or anonymized within 90 days after the Giveaway concludes, unless participants opt in to further communications.

5. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of laws principles.
